School appeals

If we have not been able to offer your child a place at one of the preferred schools listed on your application form, you have the right to appeal to an independent appeal panel.

You can only make one appeal per school, in a single academic year, unless there are changed circumstances.

There is no appeal for nursery, as this is not statutory education.

How to appeal

  1. Read our guidance and the Deaprtment for Education guidance on making an appeal.
  2. Complete an appeals form.

Appealing after the deadline

If you appeal after the deadline, your appeal will still be scheduled, but it may be heard later than those who returned their appeal forms on time.

Appeals already submitted

  • To check progress for an appeal you have already submitted to us, please contact the democratic services appeals team.
  • To check the progress for an appeal you have already submitted directly to a school, please contact that school.

Appealing a school place

  • When an infant class already has 30 pupils
  • The law states that there must be no more than 30 pupils in an infant class (reception, year one and year two).
  • An appeals panel can only allow more children in an infant class if they decide either:
  • that the admission arrangements did not comply with admissions law and the child would have been offered a place if the arrangements had complied
  • that the admission arrangements were not correctly and impartially applied and the child would have been offered a place if the arrangements had been correctly and impartially applied
  • that the decision to refuse admission was not one which a reasonable admission authority would have made in the circumstances of the case

Appeals for classes with fewer than 30 pupils in infant /junior or secondary school places

  • An appeals panel will only allow an appeal for an infant class with less than 30 pupils, or a junior or secondary school place if they decide either:
  • that the admission arrangements did not comply with admissions law and the child would have been offered a place if the arrangements had complied
  • that the admission arrangements were not correctly and impartially applied and the child would have been offered a place if the arrangements had been correctly and impartially applied
  • that the admission of additional children would not prejudice the provision of efficient education or efficient use of resources
  • that on balance the case for the child to attend that particular school outweighs the prejudice to the school.
