Alterations

An alteration is any form of change made to the original property. This can be either:

  • Structural – for example changes to the internal layout of the property; the installation of new central heating systems; fitting of new kitchens and bathrooms where services are altered or extensions.
  • Non-structural – for example replacing kitchen units and bathroom suites without changing the layout or the supply services
  • Erecting new buildings for example a shed or outbuilding 

Under the terms or your lease agreement you should not make any structural alterations or structural additions to the flat nor erect any new buildings or remove any of the landlord’s fixtures and fittings with the previous consent, in writing, of the Council. This consent is needed in addition to any Planning or Building Control consent that may be required for the work. 

Please note that consent will not be given to replace your windows. This is because under the terms of your lease, the window frames are still owned and maintained by the Freeholder.Before you start any alteration work to the property you will need to complete an application form and provide details of the alteration. Your application will need to include the following;

  • Written details of the proposed works, with proposed start and end dates
  • Legible before and after sketches (in pen), suitable for our permanent records (or detailed plans for major alterations)
  • Contact details
  • Names and contact details of proposed contractors
  • Copy of contractors’ public indemnity insurance (if appropriate)
  • Copies of Planning or Building Control consent (if appropriate)
  • Payment of our initial fees 

Each application will be taken on its own merits and consent will not be unreasonably withheld. Fee will vary depending on the level of work required. It may also be necessary to vary your lease to include the alteration. You will be responsible for both your own and the Council’s costs. 

Where alterations are made without permission it is a breach of your lease and action will be taken by the Council to remedy the breach. If the alteration was carried out by the previous owner, you will be liable for the breach and required to take appropriate action to remedy it. This may include either applying for retrospective consent or reinstating the property to its original condition.
