The Environmental Protection Act 1990 gives the Council the powers to serve an abatement notice on the person responsible for committing a statutory nuisance.
Implications
From the date shown on the notice, the person responsible will be required to stop the nuisance within a specified time or limit it to certain times of the day. There is a right of appeal against the notice (there are 21 days in which to lodge the appeal), but If the notice is ignored and the nuisance continues, a criminal offence is committed.
Prosecution can result in heavy fines of up to £5,000 for a domestic situation and up to £20,000 if the nuisance involves money or a business.
If the problem involves noise, Officers can apply for a warrant from a Justice of the Peace to seize and remove the offending equipment. The Council could apply for a deprivation order following a successful prosecution, allowing it to retain the equipment.
