Developing on potentially contaminated land

Many new developments in the borough take place on previously developed (brownfield) land.

Where there is thought to be a risk of contamination, planning officers will require proper investigation and any necessary remediation as a condition of planning permission. They will be advised on this by the borough’s land quality staff.

Contamination of land is a material consideration in the granting of planning permission. This means that planners are legally required to consider it when making planning decisions. Details of the rules surrounding planning permission and land affected by contamination can be found on the Defra website, with specific documents required for contamination control during planning and development available on the communities and local government website.

We also have a number of council documents to assist developers in planning their projects.

If you are working on a development which you think may be affected by contamination then please contact us as soon as possible so that any remedial works or protective measures can be designed and implemented at the start of development to avoid extra costs or delays in granting of planning permission.
